Terms of Service

1. Introduction and Scope

Welcome to AiFasl. These Terms of Service ("Terms") govern your access to and use of the services, websites, and applications offered by AiFasl (the "Service"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By clicking "I Agree," "Sign Up," or by otherwise using our Service, you enter into a legally binding contract with AiFasl. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. BINDING MEDICAL DISCLAIMER & LIMITATION OF USE

AIFASL IS NOT A HEALTHCARE PROVIDER. WE DO NOT PROVIDE MEDICAL DIAGNOSIS.

AiFasl provides a technology platform that utilizes Large Language Models (LLMs) and Artificial Intelligence (AI) to interpret structured data from laboratory reports. You acknowledge and agree to the following:

  • Probabilistic Nature of AI: AI-generated content is probabilistic and may produce "hallucinations," inaccuracies, or incomplete interpretations. The results are not definitive medical facts.
  • Informational Use Only: All insights provided are for educational and informational purposes only. They are intended to facilitate—not replace—the relationship between you and your healthcare professional.
  • Professional Verification: You MUST consult with a licensed medical professional before making any health-related decisions based on the Service's output.
  • No Liability for Medical Outcomes: AiFasl explicitly disclaims any liability for any clinical decisions made, or health outcomes resulting from, the use of the Service.

If you are experiencing a medical emergency, immediately contact your local emergency services (e.g., 1122 in Pakistan).

3. Definitions

"AI Content" refers to any explanation, summary, score, or recommendation generated by our proprietary algorithms and third-party AI models.

"User Data" means any information, including laboratory reports in PDF or image format, that you upload or submit to the Service.

"Anonymized Data" refers to User Data that has been programmatically stripped of personally identifiable information (PII).

"Premium Services" refers to features available only through paid subscription plans.

4. User Accounts and Eligibility

To access certain features of the Service, you must register for an account. You must provide accurate, current, and complete information during the registration process.

  • Age Requirement: You must be at least 18 years old to create an account. Users between 13 and 18 may use the Service only with parental consent.
  • Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree not to disclose your password to any third party.
  • Single User: Accounts are for individual use. Sharing account credentials with multiple users is strictly prohibited and may result in immediate suspension.

5. Proprietary Rights and License

Our License to You: Subject to your compliance with these Terms, AiFasl grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial health management.

Your License to Us: By uploading User Data, you grant AiFasl a worldwide, non-exclusive, royalty-free license to use, host, store, and process such data solely for the purpose of providing the Service to you. This license includes the right to generate Anonymized Data for the purpose of improving our AI models and service accuracy.

Ownership: AiFasl retains all right, title, and interest in and to the Service, including all AI algorithms, UI/UX designs, trademarks, and branding.

6. Acceptable Use Policy

You agree not to engage in any of the following prohibited activities:

  • Reverse Engineering: Attempting to decompile, disassemble, or reverse engineer any of the software or AI models used in the Service.
  • Automated Access: Using any robot, spider, or other automated means to access the Service or scrape data.
  • Malicious Acts: Uploading viruses, malware, or any code designed to interrupt or damage the functionality of the Site.
  • Commercial Resale: Using the AI Content generated by AiFasl for commercial medical consulting or resale to third parties.

7. Subscription Fees and Payments

AiFasl offers both free and paid subscription tiers. By selecting a Premium plan, you agree to pay the fees indicated for that service.

  • Payment Processors: We use third-party payment gateways. Your credit card information is never stored on our servers.
  • Automatic Renewal: Unless you cancel your subscription before the end of the current billing cycle, it will automatically renew.
  • Price Changes: We reserve the right to change our subscription fees at any time, with at least 30 days' notice to active subscribers.
  • Refund Policy: Due to the digital nature of the AI processing costs incurred by us immediately upon usage, all sales are final and non-refundable unless required by specific consumer protection laws.

8. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Islamic Republic of Pakistan.

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith mediation. If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts located in Lahore, Pakistan.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
